Terms of Service

By accessing or using Up North Media's website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Up North Media provides the following professional services:

• Web Development: Custom website and web application development
• SEO Marketing: Search engine optimization and digital marketing services
• AI Consulting: Artificial intelligence implementation and automation solutions
• Consulting: Strategic business and technology consulting

Specific terms for each project will be outlined in individual service agreements or contracts. These agreements will include:

• Project scope, deliverables, and timelines
• Payment terms and schedule
• Intellectual property rights
• Cancellation and refund policies
• Performance guarantees and limitations

Unless otherwise specified in your service agreement:

• Payment is due within 30 days of invoice date
• Late payments may incur a 1.5% monthly service charge
• Projects may be suspended for accounts past due
• All prices are in USD and exclude applicable taxes

Upon full payment for services:

• You own the final deliverables and custom code created specifically for your project
• Up North Media retains rights to general methodologies, processes, and frameworks
• Third-party components remain subject to their respective licenses
• Up North Media may showcase completed work in our portfolio with your permission

To ensure successful project delivery, clients are responsible for:

• Providing accurate and timely information and materials
• Responding to requests for feedback within agreed timeframes
• Ensuring necessary access to systems and platforms
• Making timely payments according to the agreed schedule

Up North Media's liability is limited to the total amount paid for services in the preceding 12 months. We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Issues arising from third-party services or platforms
• Delays caused by circumstances beyond our reasonable control

Either party may terminate services with written notice. Upon termination:

• Payment is due for all work completed to the termination date
• Deliverables will be provided for paid work
• Confidential information must be returned or destroyed
• Surviving clauses include payment obligations and intellectual property rights

These terms are governed by the laws of the State of Nebraska. Any disputes will be resolved in the courts of Douglas County, Nebraska.
